Pain Unwasted Mental Mastery Coaching Terms & Conditions/Waiver of Liability and Indemnity

WAIVER & RELEASE OF LIABILITY and INDEMNITY: THIS AGREEMENT CONTAINS A WAIVER & RELEASE OF LIABILITY AND INDEMNITY AGREEMENT TO WHICH YOU WILL BE BOUND, AND UNDER WHICH YOU WILL BE WAIVING IMPORTANT LEGAL RIGHTS. DO NOT SIGN THIS AGREEMENT, ENROLL IN, OR PAY FOR COACHING BY PAIN UNWASTED IN ANY FORM BEFORE YOU READ IT.

This waiver and release of liability and indemnity includes any risk of attending Pain Unwasted Mental Mastery Coaching sessions, engaging in Zoom sessions, coaching, or attending any events, workshops or other services provided by Pain Unwasted. Please see the detail below:

  • I understand that I should seek the advice of my physician before commencing any exercise routine.

  • I assume any and all risks of injury associated with or in any manner related to my participation in and utilization of the classes, videos, and/or livestreams provided by Jhuamia Pile (and representatives, independent therapists, or contractors working with, under, or for the group name "Pain Unwasted").

  • I agree and covenant not to sue or otherwise attempt to hold Jhuamia Pile (and representatives, independent therapists, or contractors working with, under, or for the group name "Pain Unwasted") liable for any injuries regardless of the cause.

  • I agree to indemnify and hold Jhuamia Pile (and representatives, independent therapists, or contractors working with, under, or for the group name "Pain Unwasted") harmless against any and all claims arising out of my participation in and utilization of the classes, videos, and/or livestreams provided by either aforementioned individuals or “Pain Unwasted”.

  • This waiver and release agreement is intended to be as broad as is allowed under the applicable law and applies to any and all claims for damages.

Clients using Pain Unwasted services will understand that these services are not offered as a substitute for clinical mental health care or medical care and are not intended to diagnose, treat, or cure any mental health or medical conditions. You should also understand that their coach or therapist is not acting as a medical professional.

You will understand and agree that you are fully responsible for your own well-being during your coaching and therapy sessions, and subsequently, your choices and decisions.

You will understand that as an organization we note share between coaches and therapists so that all practitioners and those involved in speaking and/or working with you can keep abreast of your story. This will always be done in a confidential way respecting your privacy and integrity.

You will also understand that all comments and ideas offered by a coach/therapist/aide are solely for the purpose of aiding you in achieving your defined goals in order to improve or enhance your mental wellbeing or mental maintenance. You will be able to give informed consent, and hereby give such consent to your coach/therapist/aide to assist you in achieving such goals. Where we think it is in the interest of your well-being, we may contact your Primary Contact to share relevant information. 

You will have read and understood the terms and conditions, Privacy Policy and other documentation relating to confidentiality and adult protection.

You will have understood that the use of technology is not always secure and accept the risks of confidentiality in the use of email, text, phone, Zoom and other technology.

You hereby release, waive, acquit and forever discharge your therapist/coach/aide, any agents, successors, assigns, personal representatives, executors, heirs and employees from every claim, suit action, demand or right to compensation for damages claimed or that you may have arising out of your own acts or omissions or acts and omissions of your coach/therapist/aide as a result of any advice given otherwise resulting from the therapeutic/coaching relationship contemplated by this agreement. You further declare and represent that no promise, inducement or agreement not expressed in this agreement has been made.

Pain Unwasted and your coach reserve the right to refuse access to the service. For all international clients all services are undertaken in accordance with the laws of the coach/therapist/aide’s own country and any disputes will be subject to that country’s law.

By participating, I hereby grant permission to Pain Unwasted the rights of my image, in video or still, and of the likeness and sound of my voice as recorded on audio or video tape without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording. I also understand that this material may be used in diverse educational settings within an unrestricted geographic area.  

Photographic, audio or video recordings may be used for ANY USE which may include but is not limited to:

  • Presentations;

  • Courses;

  • Online/Internet Videos;

  • Media;

  • News (Press)

  • Other;

By participating, I understand this permission signifies that photographic or video recordings of me may be electronically displayed via the Internet or in the public educational setting.

There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed.

This release applies to photographic, audio or video recordings collected as part of the sessions listed on this document only.

I acknowledge that I have completely read and fully understand the above release and agree to be bound thereby. I hereby release any and all claims against any person or organization utilizing this material for their purposes.

I HAVE READ THE FOREGOING WAIVER AND RELEASE OF LIABILITY AND VOLUNTARILY EXECUTED THIS DOCUMENT WITH FULL KNOWLEDGE OF ITS CONTENT.
